Disclaimer: This page describes the property law work the firm undertakes. It is general information, not legal advice, and not an advertisement or a solicitation under the rules of the Bar Council of India.

Key facts

  • The firm advises on title verification, sale and lease documents, registration, partition, mutation, conversion of land, succession and property disputes.
  • The work covers property in Kerala and Delhi, where land records and local rules differ.
  • Matters may be taken up through the firm's offices in Kozhikode, Kochi and New Delhi.

Title verification and due diligence

Before a purchase, we examine the chain of title, the encumbrance position and the revenue records, and report on any defect or doubt. The same review is useful for lenders, developers and buyers of agricultural or converted land.

Sale, lease and development documents

Sale deeds, agreements to sell, lease deeds, gift deeds, joint development agreements and powers of attorney are prepared and reviewed under the Transfer of Property Act, 1882 and the Registration Act, 1908. Stamp duty and registration requirements differ by State. See the page on legal documents.

Mutation and land records

Mutation updates the revenue or municipal record after a sale, inheritance or partition. It does not by itself decide ownership, but an outdated record can delay a sale, a loan or a conversion. We assist with applications to the village, taluk and local authorities in Kerala and with the land and building department and local bodies in Delhi.

Conversion of land in Kerala

Land recorded as paddy field or wetland is subject to the Kerala Conservation of Paddy Land and Wetland Act, 2008. We advise on whether an application for conversion or for reclassification is available and prepare it for the competent authority.

Succession and partition

The rights of heirs depend on the personal law of the family and on whether there is a will. We advise on probate, legal heir certificates, partition by agreement and partition suits. Our guide to title disputes in Kerala is an example of what we write on the subject.

Property disputes and real estate regulation

Disputes over possession, boundaries, specific performance of agreements to sell, tenancy and eviction are heard by civil courts. Complaints against promoters of registered projects may be made under the Real Estate (Regulation and Development) Act, 2016. See the page on real estate and property and the page on litigation.
